§ 642.38 PAVING AND APPLICATION OF GRAVEL IN RIGHT-OF-WAY.
   (A)   The Council finds it necessary and in the best interest of the city to prohibit paving of the right-of-way, and by reason thereof, such action is hereby prohibited.
   (B)   Such prohibition includes not only application of asphalt or concrete, but also gravel.
   (C)   This section will not apply, however, to areas in the right-of-way which were paved prior to enactment of this section.
   (D)   Permission to pave in the right-of-way can be granted by the Board of Zoning Appeals under only the most exigent circumstances.
   (E)   The Building Commissioner or his designee shall be responsible for enforcement of this provision.
   (F)   Whoever violates this section is guilty of a minor misdemeanor and shall be fined not more than $100 for each offense. Each day of violation of this section shall constitute a separate and distinct offense.
