§ 438.31 USE OF COMPRESSION BRAKES OR ENGINE RETARDERS PROHIBITED.
   (A)   The City Council finds it necessary and in the best interest of the city to prohibit the use of any and all engine retarders, including all compression brakes, Jake brakes, Jacobs Brakes, and engine braking systems produced by any manufacturer commonly used within the trucking industry, within the city on all ingress and egress ramps to and from limited access highways and all streets that are not part of a limited access highway. This section shall not apply to emergency vehicles operated by fire, police, or military units.
   (B)   Appropriate signage notifying the operators of motor vehicles of the prohibition concerning engine retarders shall be posted at the corporation limits of the city on the following streets and highways: Reading Road, Columbia Avenue, Galbraith Road, Benson Street, and Hunt Road, and upon all ingress and egress ramps to and from limited access highways intersecting with any of the above streets within the city limits.
   (C)   A violation of this section shall be a minor misdemeanor.
