§ 432.42 STOPPING OR STANDING UPON OR WITHIN FIVE FEET OF RAILROAD TRACK PROHIBITED.
   (A)   No person, being the operator of a motor vehicle, shall park, stop, or allow said vehicle to stand upon any railroad track or in any area that is within five feet of a railroad track. It is not a defense to this section that the motor vehicle was experiencing mechanical problems or was otherwise unroadworthy.
   (B)   A violation of this section is a misdemeanor of the first degree and in addition shall be punished as follows:
      (1)   An individual convicted of this section who has not been previously convicted of a violation of this section shall be fined not less than $500;
      (2)   An individual convicted of a violation of this section who has previously been convicted of a violation of this section shall be fined not less than $1,000.
