(A) Classification of positions. Positions in the civil service of the city shall be classified in accordance with an established plan which shall provide that any and all positions whose duties, responsibilities, and necessary qualifications are sufficiently alike to so warrant, shall be allocated to the same classification with a title which shall be descriptive of the duties performed and with a salary range which will compensate each employee assigned to the classification on a like basis.
(B) Classification specifications. A classification specification shall be prepared for each position setting forth the classification, title, typical duties and responsibilities, and the necessary qualifications. The specification shall set forth the factors and conditions which are essential characteristics of the classification and also factors and conditions which separate it from other classifications.
(C) Minimum qualifications.
(1) Minimum qualifications shall be established for the classifications in the classification plan. The minimum qualifications shall be based on the requisite skills, knowledge, and abilities required of an individual to perform the tasks required to be performed in a classification. All minimum qualifications required of a classification or position shall be reasonably related to the duties required to be performed in the classification and shall not be used to unlawfully discriminate.
(2) Classification specifications shall include a statement or summary of the essential knowledge, abilities, skills, and qualificationsrequired for a person to fill a position in the classification. Such required knowledge, abilities, skills, and qualifications shall be known as the minimum qualifications for the classification.
(3) Qualifications shall be stated in terms of specific coursework at recognized institutions, experience, training, or in such other terms as to meet the requirements of the classification.
(4) The minimum qualifications shall make reference to the following when required for a position or classification: age, education, experience, license requirements, certification requirements, physical condition, or bona fide occupational qualifications.
(5) Special minimum qualifications may be established for a position within a classification if the required skills of the position vary significantly enough from the classification so as not to require the special minimum qualifications for the entire classification.
(D) Position audits and reassignments.
(1) The Commission shall assure that all positions are standardized. Any employee or his authorized representative or any appointing authority desiring to submit facts concerning classification of positions for consideration of the Commission shall be afforded reasonable opportunity to do so. When the Commission finds improper classifications of positions exist, the Commission may reallocate any position to the appropriate classification as is necessary to provide an equitable, just, and proper classification. When the Commission proposes to reclassify any employee so that the employee is adversely affected, the Commission shall give the affected employee, and the affected employee's appointing authority, written notice setting forth the proposed new classification, pay range and salary.
(2) Upon the request of any classified employee who is not serving a probationary period, the Commission shall perform a job audit to review the duties assigned to and/or performed by the incumbent to determine whether the position is properly classified.
(E) Incumbents of positions reclassified due to changes made to the classification.
(1) Whenever positions are allocated to a new classification due to the merger, abolition, modification, or creation of classifications and/or classification specifications, the employee assigned to any such position shall be reassigned to the position. Any such employee reassigned shall not be subject to civil service examination for the subsequent classification and shall be automatically certified in the subsequent classification.
(2) Whenever the classification title of a position is changed other than by promotion or demotion, the Commission shall notify, in writing, any employee affected by the change as well as the employee's appointing authority.
(F) Appeal of a reclassification. Any employee or appointing authority may appeal the reclassification of any position to the Commission within 30 days after receiving the notification of reclassification.
(G) Cooperation with Mayor. The Commission and the Mayor shall cooperate in the implementation and maintenance of the classification plan for the city. The Commission shall not be responsible for the individual position descriptions for positions within the city. The Commission may delegate to or authorize the Mayor the responsibility to administer and maintain the classification system, including any or all of the functions listed above.
