For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
APPOINTING AUTHORITY.
Refers to the officer, commission, board, or body having the power of appointment to, or removal from, positions in any office, department, commission, board or institution. The term
APPOINTING AUTHORITY
shall include, but not be limited to, the following: Auditor, Board of Education, Civil Service Commission, Council, Mayor, Director of Public Safety and Service, and the City Law Director.
CERTIFICATION.
The process of providing to an appointing authority the names of an eligible list, jurisdictional layoff list, or an agency layoff list.
CIVIL SERVICE.
Includes all offices and positions of trust or employment in the service of the city, the Reading City Health District and the Reading City School District.
CLASSIFICATION PLAN.
A system of classifications which may include pay range assignment for each classification.
CLASSIFIED SERVICE.
That employment which is governed by civil service laws and under which the employee has vested tenure rights and the right to appeal certain job actions as set forth in civil service law or these rules. The classified service issubject to examination procedure.
CLASSIFIED SERVICE
shall comprise all persons in the employ of the city, the Reading City Health District, and the Reading City School District not specifically included in the unclassified service. The classified service shall be divided into the
COMPETITIVE CLASS
and the
UNSKILLED LABOR CLASS
. as provided for in division (B) of Ohio R.C. 124.11.
(1) The competitive class shall include all positions and employment with the city for which it is practicable to determine the merit and fitness of applicants by competitive examination.
(2) The unskilled labor class shall include ordinary unskilled laborers. Vacancies in the labor class shall be filled by appointment from lists of applicants registered by the Commission. An applicant for registration shall be required to furnish such evidence or take such tests as the Commission considers proper with respect to age, residence, physical condition, ability to labor, honesty, sobriety, industry, capacity, and experience in the work or employment for which application is being made.
COMMISSION.
The Municipal Civil Service Commission of the City of Reading, Ohio.
COMPETITIVE CLASS.
All positions in which the applicant's knowledge of the duties of the position can fairly be determined by an examination through which an eligible register shall be established.
COOPERATIVE STUDENT EMPLOYEE.
Signifies an employee who is regularly enrolled in a public school, college or university and who is working in the employ of the city in furtherance of his or her education.
ELIGIBLE LIST.
A list of names and scores of individuals who have taken an examination for a specific classification.
EMERGENCY APPOINTMENT.
An appointment to a position to meet an emergency situation, not subject to civil service law, and limited to a maximum of 30 days.
EMPLOYEE.
Signifies any person holding a position subject to appointment, removal, promotion, or reduction by an appointing authority.
EXEMPTED POSITION.
Those positions which have been properly filed with the City Civil Service Commission, as exempt from civil service protection and incumbents which serve at the pleasure of the appointing authority.
HE.
The masculine pronoun and its derivatives, whenever employed, include the feminine pronoun and its derivatives.
HEALTH DISTRICT.
Signifies the Reading City Health District.
MUNICIPAL SERVICE.
Those positions in the classified service of the city, City Health District and City School District.
NEW POSITION.
A budgeted position established and properly allocated which did not previously exist and is not merely the expansion or change in a previously existing position.
NON-COMPETITIVE CLASS.
All positions requiring peculiar and exceptional qualifications of a scientific, managerial, professional or educational character, as may be determined by the rules of the Commission such as doctor, lawyer, nurse, etc.
PERMANENT EMPLOYEE.
Any person holding a position that requires working a regular schedule of 26 consecutive bi-weekly pay periods, or any other regular schedule of comparable consecutive pay periods, which is not limited to a specific season or duration. It does not include student help, intermittent, seasonal or interim employees, or individuals covered by personal service contracts.
POSITION CLASSIFICATION.
A group of positions sufficiently similar in respect to duties, responsibilities, authority, and qualifications so that the same descriptive title may be used, the same pay range assigned and the same examinations conducted for each.
POSITION.
The group of job duties intended to be performed by an individual employee as assigned by the Commission or appointing authority.
PROMOTION.
The movement of an employee from one position to another position for which the classification is assigned to a higher pay range, or a higher salary where pay ranges do not exist.
PROVISIONAL EMPLOYEE.
Signifies any employee temporarily filling a position without competition pending the establishment of an eligible list and continuing only until appointment from an eligible list can be made or until certification is made pursuant to the Ohio Revised Code.
SCHOOL SERVICE.
Those positions in the classified service of the city School District.
SCHOOL DISTRICT.
Signifies the Reading City School District.
SEASONAL EMPLOYEE.
Signifies a position in the competitive class where the nature of the work is such that the service is not continuous through the year but recurs in each successive calendar year.
STUDENT EMPLOYEE.
Signifies an employee who is regularly enrolled in a public school, college, or university and who is working part-time for the city.
TEMPORARY APPOINTMENT.
An appointment for a limited period of time, fixed by the appointing authority and approved by the Commission either from an eligible list or by the provisional appointment process for a period not to exceed six months.
UNCLASSIFIED SERVICE.
All offices and positions which are exempt from all examinations and which provide no tenure under the law. Appointment to a position in the unclassified service may be made at the discretion of the Commission and/or appointing authority and the incumbent may be removed, suspended or reduced from the position at the pleasure of the Commission and/or appointing authority. Positions in the unclassified service shall be exempt from all examinations required by Ohio R.C. 124.01 to 124.64.
