It shall be unlawful for any person to operate or be in actual physical control of any motor vehicle while under the influence of alcoholic liquor or of any drug. Any person who shall operate or be in actual physical control of any motor vehicle while under the influence of alcoholic liquor or of any drug shall be deemed guilty of a crime and, upon conviction thereof, such person shall be punished as provided by state law. For purposes of this section, the determination of whether an individual is under the influence of either alcohol or drugs shall be as prescribed in the state statutes.
