This chapter regulates the installation of drain tiles, other tiles or culverts across county roads in the county; setting forth the standards and requirements for the installation of such tiles or culverts, the specifications and requirements of the tile or culverts themselves and providing for notification to the County Highway Superintendent of their intention to so cut the county road for the purpose of installing such tile or culverts; setting standards and requirements for the construction of the driveways which exit upon county highways which will require culverts to be constructed parallel to county highways.

Any person desiring to install drain tile, other tile or culverts across county roads in the county shall first file a written request to the Auditor of the county, said request to be submitted to the Board of Commissioners of the county at the next regular meeting from the date of submission of such request and such request to contain the following information:
(A) The designation of the road across which such tile or culvert will be installed and a statement as to the exact location where such tile or culvert shall be installed;
(B) A statement as to the nature of the tile and size of such tile or culvert contemplated being used, as well as a statement of the size of any tile or culvert then existing down stream from the installation contemplated;
(C) The name of the contractor who will be installing such tile or culvert; and
(D) A statement as to whether or not the United States Soil Conservation Service is assisting the applicant in such project.

Any installations contemplated herein must meet the following standards.
(A) The tile or culvert to be installed by applicant shall be either corrugated metal pipe, helical aluminum or vitrified clay tile for the entire right-of-way, except that plastic tile may be used under driveways and in side ditches along roads.
(B) Such tile or culvert shall be the same size as any tile or culvert being used downstream from the installation.

Any applicant must notify the County Highway Superintendent at least two days before the road is to be cut.

The installation of such tile or culvert shall be made only at times that will not inconvenience or interfere with the mail delivery or school bus route.

All applicants must post road closed signs as needed and shall backfill the trench the same day as the date of the installation of such tile or culvert.

Any persons constructing driveways that exit upon the county roads shall not install a culvert across the said driveway, parallel to such county road until such person has complied with the following requirements.
(A) Such persons shall make application to the County Highway Superintendent and the County Highway Superintendent shall specify the size and kind of culvert to be installed and in no event shall the size of such culvert be less than 12 inches in diameter.
(B) The said culvert shall be installed a minimum of 20 feet from the centerline of such county highway but the County Highway Superintendent may require such installation to be made a distance of more than 20 feet from such centerline and in all case where he or she shall deem it to be necessary to preserve the safety and well being of the members of the general public using said highway.
