Any Animal Control Officer or law enforcement officer shall have the authority to enter onto private or public property for the purpose of ensuring compliance with the provisions of § 90.117(B).

The Animal Control Officer or law enforcement officer shall immediately impound a dangerous dog upon the determination that one of the following circumstances exists:
(A) The dog is not validly and currently registered as required by § 90.120;
(B) The dog is not maintained in a proper enclosure; and

Any dangerous dog which has been impounded under §§ 90.124 or 90.173 of this chapter shall be returned to its owner upon the owner’s compliance with the provisions of this chapter and upon the payment of actual boarding expenses, any veterinary expenses plus a reasonable confiscation fee, which shall be $50 upon the first confiscation of any dog, $100 upon the second and $200 upon the third or subsequent confiscation. If the owner has not complied with the provisions of this chapter and paid such confiscation costs within 14 days of the date of confiscation, the dog shall be destroyed in an expeditious and humane manner.

DOGS, CATS, FERRETS: SPECIAL REQUIREMENTS
(A) It shall be the duty of each dog owner or possessor to provide a collar or harness and identification tag for each dog, and the tag and collar or harness shall be on the animal at all times when the animal is not under the immediate control of the owner or possessor of the animal.
(B) The owner or keeper of an animal vaccinated for rabies shall keep a copy of the certificate and tag until such time as the animal must be revaccinated. It is recommended that the owner or keeper of a dog affix the rabies vaccination tag to the collar or harness of the dog and that it be worn at all times.

(C) It shall be unlawful for any person to attach a vaccination or owner’s license tag to the collar of any animal for which it was not issued, or to remove such tags from any animal without the consent of its owner or keeper.

LICENSING
(A) The provisions of this subchapter shall apply to dogs.
(B) Any animal declared by its owner or keeper to be a wolf-hybrid shall be considered a dog under this chapter and subject to all provisions relating to dogs under state law and this chapter with respect to the possession, ownership and licensing of the animal, including the requirement to vaccinate the animal against rabies.
