§ 90.021 TRANSPORT OR SALE OF UNDERAGE ANIMALS.
   (A)   No person may import to, or export weeks unless the dog is transported from, the state for the purpose of sale any dog under the age of eight weeks with its dam.

   (B)   (1)   Unless the mother animal is unable to care for her baby, no underage animal may be offered for sale, trade or for other compensation or for free giveaway.
      (2)   The definition of underage depends upon the species. For example:
         (a)   A puppy or kitten that is under the age of eight weeks;
         (b)   A bird less than three weeks of age; or
         (c)   A rabbit less than two months of age.
   (C)   This does not apply to commercial breeders, distributors or shelters whose facilities are adequately equipped for the care of young animals.

§ 90.022 POISONOUS FOOD PROHIBITED.
   (A)   No person shall knowingly place food of any description containing poisonous or other injurious ingredients in any area reasonably likely to be accessible to animals, except as provided by law for rodent control.
   (B)   The only exception will be by written permit from the Department of Health for the purpose of controlling diseases transmissible to humans or other animals and only when all other methods and means have been exhausted.
   (C)   Such a written permit shall name the person or persons conducting the poisoning, specify the products to be used, give the boundaries of the area involved, and specify the precautionary measures to be employed to ensure the safety of humans and other animals. Any drug used for euthanasia shall be by or under the direction of a licensed veterinarian.

§ 90.023 PUBLIC NUISANCE ANIMALS.
   Persons owning or keeping a public nuisance animal as defined in this chapter (§ 90.002) will be held accountable for the animals actions as provided by the law.

§ 90.024 PROCEDURE AND REPORTS CONCERNING BITING ANIMALS.
   (A)   The person responsible for any domestic animal that has bitten a person or another domestic animal must immediately report the incident to the County Health Department or any county law enforcement agency to fill out an official state animal bite report. Any person or parent of a minor child who is a victim can report the incident to the County Health Department or any county law enforcement agency or any hospital, physician’s office or other health care provider, or a veterinarian may fill out an official state animal bite report and mail or fax it to the County Health Department and/or local county law enforcement agency.
   (B)   Upon receiving the notification or report of a bite the animal owner must provide proof of up-to-date rabies vaccination. If said proof cannot be shown immediately the animal will be quarantined for ten days, at the expense of the owner, keeper or agent at the Humane Society of Putnam County animal shelter or other designated facility. If said proof is provided the animal may be quarantined at the animal owner’s home for ten days. During the quarantine period, the animal is to be securely confined and kept from contact with any other animal or person, 410 I.A.C. 1-2.5 and I.C. 15-17.
   (C)   During the period of quarantine the animal must be observed for signs of aggression, depression, convulsions, excessive salivation, paralysis or the inability to eat/drink.
   (D)   Prior to the release of an animal quarantined at the Humane Society of Putnam County or other designated facility, the full amount of quarantine fees, boarding fees and any veterinary expenses must be paid and the rabies vaccination pre-paid with the receipt to be presented as proof.

ADEQUATE SHELTER, SPACE, FOOD AND WATER
§ 90.040 ADEQUATE SHELTER, SPACE, FOOD AND WATER TO BE PROVIDED.
   It is not considered animal cruelty to house an animal outdoors. However, all animals must be provided adequate food, a constant supply of clean water and adequate shelter from the weather at all times and medical care when needed to prevent suffering.

§ 90.041 ADEQUATE SHELTER.
   (A)   Shelter for animals must be appropriate for the species; accessible to each animal and large enough to allow each animal to sit, stand and lie in a normal manner, and to turn around freely; provide adequate protection from the sun, wind, rain or snow.
   (B)   The space must be reasonably free from standing water, accumulated waste, sharp objects and debris.
