(a) Whoever violates any of the provisions of this chapter, for which no penalty is otherwise provided, is guilty of a minor misdemeanor and shall be fined not more than one hundred dollars ($100.00) for each offense. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.

(b) Whoever violates Section 1040.02 is guilty of a misdemeanor of the first degree and shall be fined not more than one thousand dollars or imprisoned not more than six months, or both. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.

(c) (1) Whoever violates or fails to comply with any of the provisions of Section 1040.09 shall be fined twenty-five dollars ($25.00) for a first offense. For a second offense, the person shall be fined fifty dollars ($50.00). For a third or subsequent offense, the person is guilty of a minor misdemeanor and shall be fined not more than one hundred dollars ($100.00).
(2) Fines imposed for a first or second offense shall be imposed by the Village Administrator and Water Plant employees. In the case of a third or subsequent offense, Village police officers shall issue a citation upon notification by the Village Administrator or employees of the Water Plant.
