(a) It shall be unlawful for a pedicab driver to operate a pedicab unless the pedicab driver shall have first obtained a pedicab driver license from the Village.
(b) It shall be unlawful for a pedicab business to permit the operation of any pedicabs owned by it by a person who does not have a pedicab driver license and a motor vehicle driver's license in full force and effect.
(c) In order to obtain or renew a pedicab driver license, a pedicab driver shall file an application with the Mayor, or his/her designee, for such pedicab driver license. Such application shall be made upon such form as prescribed by the Mayor and shall contain such information as the Mayor may require to establish the applicant's eligibility for a pedicab driver license under this subchapter.
(d) To be eligible for a pedicab driver license, an applicant shall:
(1) Be at least 18 years of age;
(2) Possess a currently valid motor vehicle driver's license and be in compliance with all provisions of the Ohio Revised Code applicable to licensing as a driver and financial responsibility or insurance; and is not under suspension of driving privileges in any state;
(3) Not have his or her State of Ohio motor vehicle driver's license suspended or revoked; and
(4) Meet the other requirements of Section 866.24 of the Village Ordinances for the issuance of a taxicab driver's license, not inconsistent with divisions (d)(1), (d)(2), and (d)(3) of this section.
(e) A pedicab driver license issued pursuant to this chapter shall expire on February 15th of each year. There shall be a fee of thirty-five dollars ($35.00) for the issuance of such license.
(f) The Mayor may refuse to issue a pedicab driver license or to renew such a license based upon a determination that such pedicab driver has engaged in conduct which would constitute a basis for the suspension or revocation of a taxicab driver license as set forth in Sections 866.25 and 866.30 of the Village Ordinances. If the Mayor denies or refuses the issuance or renewal of a pedicab drivers license the applicant may appeal the denial to the Village Council pursuant to the provisions of Codified Ordinance Section 802.12.
