A. Written application for water main extension. Prior to beginning any work in regard to the extension of water mains, the property owner, developer, or others desiring the approach main shall apply in writing for such extension with Purcell.
B. Ownership of new main extensions. All new main extensions and appurtenances that are to be connected to and served by the City's existing water distribution system shall become the property of the City upon completion and acceptance by the City. The applicant shall convey such main extensions and appurtenances to the City by quit claim deed, warranty deed, assignment, or dedication along with any/or all respective easements and/or rights-of-way obtained prior to connection with the City's existing water mains and in addition the applicant shall furnish a one (1) year maintenance bond thereon to run from the date of acceptance by the City. The type of conveyance shall be at the option of the City. The applicant for the main extension shall have no interest therein after the conveyance other than the right to receive service therefrom and the contract rights reimbursement pursuant to the terms and conditions outlined herein.
C. Acceptance of new main extensions. Before any newly constructed main is connected to the City's existing water distribution system and final approval and acceptance of the new main extension is made by the City, the applicant shall furnish evidence satisfactory to the City that the cost of all materials, labor, and equipment used to construct the new main extension has been paid. After satisfactory evidence has been provided to the City that payment of all construction expenses related to the main extension has been made and after receipt by the City of the conveyance(s) described in subsection (B) above, the City will accept the new main extension into its water distribution system from the point of connection to the existing system to and including the water meter(s) and thereafter be responsible for maintenance and upkeep.
D. All customers shall conform to City regulations. All customers obtaining water service from the City water distribution system shall conform to all rules, regulations, ordinances, rates, conditions of service, and practices now prevailing or which may be established by Purcell in the future.
E. No water mains until on-site sewerage systems are assured. Water mains shall not be extended to any user until provisions have been made for on-site sanitary sewerage facilities to serve the user, and the construction of an approved system is assured, except where water is to be used for agricultural or other purposes that do not result in the production of objectionable waste. The approval shall be by the Department of Environmental Quality. Purcell shall not have any obligation or responsibility to inspect or approve sanitary sewerage facilities.
F. Water facilities constructed to Purcell standards. All water mains, valves, fire hydrants, service connections to the property line, meters, and appurtenances shall be constructed in accordance with Purcell specifications.
G. Cost of mains. All approach mains and internal mains and/or respective easements and/or rights-of-way will be constructed/obtained at the expense of the person or persons desiring service which may be either the property owner, developer, or others desiring distribution main installations; provided, that with the approval of Purcell, the City may extend any grid main which is determined to be feasible and in accordance with existing or future policies of Purcell. Provided further that if the City requires an approach main or boundary main of a diameter greater than what is necessary to provide adequate water service to the proposed development, the City may pay the cost in excess of the cost for the approach main proposed by the developer based upon the actual bid prices compared to costs as calculated by the City for the greater-sized main.
H. Approach mains, recovery of costs. When an approach main is installed by a developer to serve a subdivision, and such main is located along a section line right-of-way, and said main abuts intervening property, the developer shall be entitled to recover a part of the costs of said approach or boundary main from the owners of the property connecting to such main prior to such properties obtaining service from the main in accordance with the connection fee outlined below. Where such mains are constructed by the City, or at the request of the City for a greater size main, the City shall be entitled to a similar or a proportion of the reimbursement, respectively, at a rate to be established in accordance with the connection fee then in force and effect.
I. Water tap fee. All taps that are required to be made to the City's existing water system to serve new mains that have been constructed by applicant shall be made by the applicant or applicant's contractor. The water tap fee shall be in addition to the connection fee and will be based on City tap fees as they exist at the time of connection which may be modified by the City from time to time. Regardless, such taps shall be made at the expense of the applicant. All connections to the taps shall be made by the contractor at applicant's expense under the supervision of the City. The sterilization shall be performed by applicant or applicant's contractor when authorized by the City and shall comply with standards approved by Purcell. The applicant's responsibilities include prevention of contamination, preliminary flushing, and provisions for adequate drainage. The applicant's cost shall include payment for water, chemicals, or other materials used in the sterilization process.
J. Connection fees.
1. Policy for application of connection fees. The policy of Purcell is that property owners connecting to approach and internal mains shall participate in the cost of water main extensions which serve their property prior to obtaining any water service from such mains.
2. Basis for connection fee. The amount of connection fee shall be set by Purcell by resolution based upon agreement between Purcell and each developer.
3. Records. Purcell shall maintain records of all mains where connection fees are applicable and shall collect such fees prior to allowing taps on such mains.
4. Time period limitation. The developer who has borne the cost of installing approach and internal water mains shall be entitled to reimbursement from the connection fees actually collected by the City for a period of ten (10) years from the date that such main extensions are approved by the Oklahoma Department of Environmental Quality or until developer has been reimbursed all costs associated with the water main extension, whichever occurs first. Purcell will be entitled to all fees after the ten (10) years or after developer has been fully reimbursed. Where approved mains are constructed with Purcell funds, the City and/or authority, respectively, will be entitled to reimbursement of the connection fees, until the expenditures of the City and/or authority have been recovered. Reimbursement for the developer's cost of construction of a project shall only be pursuant to the receipt of the connection fees as set forth herein.
5. No connection fee shall be charged for Purcell-owned fire hydrants or connections to properties or facilities owned by the Purcell.
6. Ten percent (10%) of all connection fees collected by the Purcell shall be retained by Purcell to defray administration costs.
7. The City Manager is hereby authorized to adopt rules, regulations and forms consistent with this policy for administration of this policy.
