It is unlawful for any person confined in the City jail or other place of confinement by the City, or working upon the streets or other public places of the City in pursuance of any judgment, or otherwise held in legal custody by authority of the City, to escape or attempt to escape from any such jail, prison, or custody. Provided, however, that this section shall not apply in any case where the prisoner in question is in custody upon a charge or conviction of a felony.
