It is unlawful for any person, by force or fraud or in any other illegal manner, to set at liberty, rescue, or attempt to set at liberty any prisoner or prisoners from any officer or employee of the City having legal custody of the same or from the City jailer other place of confinement by the City or to assist such prisoner in any manner to escape from such prison or custody either before or after conviction, including escape from a vehicle of confinement. Provided, however, that this section shall not apply in any case where the prisoner in question is in custody upon a charge or conviction of a felony.
