A. It shall be unlawful for any person, owner or possessor to permit such animal to attack or bite any person or animal upon the premises of the person, owner or possessor. It shall be an affirmative defense to this subsection when such premises are previously posted at each entrance to the same with prominent and conspicuous signs warning all persons in lettering not less than two (2) inches in height, of such animal. It is also an affirmative defense to this subsection that the use of such animal to attack or bite any person was necessary to prevent or apprehend a person engaged in committing an act of violence, robbery or theft upon said property.
B. It shall be unlawful for any person, owner or possessor to permit such animal to attack or bite any person or animal not upon the premises of such person, owner or possessor.
C. For the purposes of this section, the word attack shall mean violent or aggressive physical contact.
D. The provisions of this section shall not apply to any law enforcement officer who uses or employs an animal while engaged in law enforcement activities, nor to any owner, possessor or keeper whose animal attacks or bites a person engaged in physically attacking or striking said owner, possessor or keeper.
