A. Buildings where marijuana is stored or dispensed must be equipped with ventilation/air filtration systems so that no odors are detectable off premises.
B. The retail establishment must collect the applicable sales tax on all sales as per state and local regulations and must be in an area that is zoned for commercial or industrial purposes.
C. Any violation of this section may result in the revocation of the Retail Marijuana Establishment License for a period of up to two (2) years from the date of revocation. Determination of violations that result in revocation shall be made by the City Manager or his/her designee.
D. It is the intent of the City of Purcell that nothing in this Ordinance be construed to:
1. Allow persons to engage in conduct that endangers or causes a public nuisance;
2. Allow the use of marijuana for non-medical purposes; or
3. Allow any activity that is otherwise illegal and not permitted by state law.
