8-1-3: OBSTRUCTING UTILITY EASEMENTS, RIGHTS OF WAY:
   A.   Permanent Improvements: It is unlawful for any person to knowingly or intentionally construct or allow to be constructed any permanent improvements upon real property owned or occupied by them which is burdened by a permanent utility easement or right of way of record in favor of the city or its municipal utility board.
   B.   Activities: It is unlawful for any person to knowingly or intentionally conduct or allow to be conducted any activity upon real property owned or occupied by them which interferes with or obstructs the operation, maintenance or repairs of the facilities placed upon, in, under or above the real property by virtue of a permanent utility easement or right of way of record in favor of the city or its municipal utility board.
   C.   Knowingly Or Intentionally Committed Defined: For the purposes hereof, a person shall be deemed to have knowingly or intentionally committed the conduct prohibited herein if after notice of a violation hereunder, the person fails to remedy the situation within a reasonable period of time depending upon the particular obstruction.
   D.   Penalty: Any violation hereof shall be punishable as provided in section 1-4-1 of this code. (1988 Code § 17-102.1)
