It shall be the duty of every policeman, on observing or being informed of any opening or excavation in any public way, to require the person making such opening or excavation to exhibit the authority or permission therefor. If none has been given by the proper officer, or if such exhibition thereof be refused, the policeman shall without delay report the same to the commissioner of public works. (1965 Code)
