169.02 VACATIONS.
   (a)   All regular employees of all departments of the City, or as provided in subsection (b) hereof or in Section 169.17, upon computation of one year's service with the City, shall receive ten work days of vacation leave with pay. Each employee after five years' service shall receive fifteen work days of vacation leave with pay. Each employee after ten years' service, shall receive twenty work days of vacation leave with pay. All vacation credit except the first twelve months' period, shall be computed as of January 1st, and shall include years of service to be established during that year. (Ord. 2015-42. Passed 7-13-15.)
   (b)   Department heads, (except elected officials), directors and other high level staff personnel as approved by the City Manager, the City Clerk and employees of the Office of the City Solicitor, and employees of Portsmouth Municipal Court upon computation of one year’s service with the City, shall receive fifteen work days of vacation leave with pay. Each employee after five years’ service shall receive twenty work days of vacation leave with pay. Each employee after ten years’ service shall receive twenty-five work days of vacation leave with pay. Each employee after fifteen years’ service shall receive thirty work days of vacation leave with pay. All vacation credit except the first twelve months period, shall be computed as of January 1st, and shall include years of service to be established during that year.

   (c)   If one of the twelve holidays, as enumerated in Section 169.06, falls within a vacation period of the employee, the employee shall receive an additional day of vacation.
 
   (d)   Vacation schedules shall be arranged between the employee and their superior at a time that is mutually satisfactory, seniority being used as the basis of selection, where possible.
 
   (e)   All vacations provided for in this section are non-accumulative from year to year and shall be taken only with the approval and consent of the department head. December 31 of each calendar year terminates the vacation privileges for that year. However, if, because of an emergency situation, an employee is unable to take his vacation prior to December 31 then, with the approval of his department head and the City Manager, the termination date shall be extended until March 1 of the following year. In no case shall a vacation for two consecutive years be taken at the same time.
 
   (f)   All special questions or instances arising as to the interpretation of this section shall be resolved through rules and regulations established by the City Manager.
 
   (g)   Contingent upon the approval of the City Manager and if the workload warrants, department heads may work during their allotted vacation period, and shall be reimbursed at their normal rate of pay plus their vacation pay.
