(a) Whenever the owner, agent, operator or occupant of a structure or premises fails to comply with any notice of the Housing Inspector, the Inspector may issue a notice to such owner, agent, operator or occupant, ordering such structure or premises to be vacated within a reasonable period of time, not to be less than ten (10) days.
(2) The ten (10) day time period notice requirement does not apply to emergencies, which situations are regulated by Section 1345.05.
(3) In addition to, or as an alternative to the notice to vacate the premises, as set forth hereinabove, the City may, upon request by the Housing Inspector, institute an action for compliance against an owner, agent, operator or occupant of a structure who has failed to comply with any notice given by the Inspector.
(b) Whenever the owner, agent, operator or occupant of a structure or premises fails, neglects or refuses to timely comply with a notice to vacate issued by the Housing Inspector, the Inspector may enforce the orders of such notice of vacation and cause the structure or premises, or part thereof, to be vacated in accordance with the terms of such notice.
(c) Whenever the owner, agent or operator of a structure or premises fails, neglects or refuses to comply with a notice to demolish such structure, or a part thereof, or a secondary or accessory structure, issued in accordance with the provisions of this Housing Code, and when such structure is determined by the Building Official to constitute a public nuisance in that it is dangerous or injurious to the public health, safety and welfare, the Inspector may request the Director of Law to institute legal proceedings or to take such other action as may be necessary to abate the nuisance. The Inspector shall further give notice, in the same manner as provided in Section 1345.03, informing the owner, agent or operator that unless a timely appeal is filed pursuant to law, such determination and action shall be implemented.
