It shall be unlawful for any person, firm or corporation to sell beer, wine or mixed beverages within the limits of the city, or operate longer hours, without the person, firm or corporation having first obtained a license by paying to the City Secretary, an annual fee as set forth herein, or to engage in any business for which a permit or license is required by the Alcoholic Beverage Code and paying to the city the following, which shall not exceed 50% of the fee charged by Senate Bill 285 (Chapter 278, Acts of the 68th Legislature, Regular Session, 1983, compiled in the Alcoholic Beverage Code, Vernons Tex. Civil Statutes), to wit:

The sale of mixed beverages and the offer to sell them by the holder of a mixed beverages late hours permit and the sale, offer to sell and delivery of beer or wine by a holder of a retail dealer's on-premises late hours service is approved to allow the above activities to occur between midnight and 2:00 a.m. on any day.

(A) Generally. Any person violating any provision of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.
(B) Extended hours. Any person, firm or corporation violating any provision of § 110.02 shall be guilty of a misdemeanor and upon conviction thereof, shall be subject to a fine of not more than $200 for each violation hereof and each day the violation shall be permitted to exist shall constitute a separate offense.
