3-3-3: CONTROL BY CITY:
Should any owner, person in possession, or person in control of private property fail to control dust originating on said property, such that the dust becomes, or may become, a hazard and danger to the health and safety of the public, the city may take reasonable steps to control said dust on the private property and levy a special assessment, as provided by Idaho Code section 50-334 and Idaho Code section 50-1008, on the lands and premises whereon the nuisance is situated to defray the cost of dust control or to reimburse the city for the cost of dust control.
