ADOPTING ORDINANCE
ORDINANCE NO. 2008-6
An ordinance of the city of Ponderay, Idaho, adopting titles 1, 2, 3, 4, 5, 6, 7, 8, 9, and 10 of the revised and amended municipal code of the city of Ponderay; repealing provisions in conflict therewith; and providing for publication.
WHEREAS, the city of Ponderay has conducted a revision of titles 1, 2, 3, 4, 5, 6, 7, 8, 9, and 10 of the municipal code of the city of Ponderay; and,
WHEREAS, such revisions have been made by the city of Ponderay in consultation with Sterling Codifiers, a specialized and professional municipal code preparer; and,
WHEREAS, such revisions have been made to provide consistency in the application and enforcement of the accumulated and modified code and ordinances of the city of Ponderay; and,
WHEREAS, the revised provisions are in the best interest and to promote public safety and health of the citizens and properties in the city limits of the city of Ponderay and are a reasonable and necessary exercise of the powers granted to municipal corporations in the state of Idaho;
NOW, THEREFORE, BE IT ORDAINED by the mayor and city council of the city of Ponderay, Idaho:
1. The attached and incorporated titles 1, 2, 3, 4, 5, 6, 7, 8, 9 and 10 of the revised and amended city code are in the best interests of the citizens and properties of the city of Ponderay.
2. The attached and incorporated titles 1, 2, 3, 4, 5, 6, 7, 8, 9, and 10 of the revised and amended city code are hereby adopted and approved.
3. Any provision of city code or any ordinance previously adopted which is in conflict with the provisions of titles 1, 2, 3, 4, 5, 6, 7, 8, 9 and 10 attached hereto and incorporated herein, are hereby repealed.
4. The provisions of the attached and incorporated titles 1, 2, 3, 4, 5, 6, 7, 8, 9, and 10 of the revised and amended city code are independent and severable. If any provision should subsequently be found to be unlawful or invalid, said finding shall not affect any other provision of said titles or revised and amended city code.
5. Any violation of previously existing city code or ordinances which occurred prior to the adopting of the attached and incorporated titles 1, 2, 3, 4, 5, 6, 7, 8, 9, and 10 shall be enforceable under said prior provisions subject to the applicable statutes of limitation for enforcement thereunder.
6. The provisions of titles 1, 2, 3, 4, 5, 6, 7, 8, 9, and 10 of the revised and amended city code are attached hereto and incorporated herein in their entirety by reference and of the same force and effect as if set forth individually and fully herein.
7. This ordinance shall be in full force and effect upon publication according to law.
8. This ordinance and/or its summary shall be published in one issue of the Bonner County Daily Bee, which is hereby declared to be the official newspaper of the city for the publication of this ordinance.
Passed by the city council and approved by the mayor, under suspension of the rules, as an ordinance of the city of Ponderay, Bonner County, Idaho, at a regular meeting of the Ponderay city council held on the 15th day of September, 2008.
