2-2-8: RENEWAL:
   A.   Filing Application: An application to renew a liquor, beer or wine license shall be physically filed with City Clerk prior to the expiration of the existing license, but in no event less than five (5) days nor more than sixty (60) days prior to the expiration of the existing license.
   B.   Issuance Or Renewal Of State And County License: An application to renew a liquor, beer or wine license shall include evidence of the issuance of the renewal of the applicant's license by the Director of the Department of Law Enforcement of the State of Idaho pursuant to Idaho Code and by the appropriate County authority, if required by law.
   C.   Approval/Denial: Upon filing of a completed application to renew a liquor, beer or wine license, the city clerk shall approve or deny said application.
   D.   Notice Of Denial: If the city clerk denies an application to renew a liquor, beer or wine license, notice of said denial shall be provided to the applicant within ten (10) days. The notice shall set forth the grounds for denial and shall state that the applicant has ten (10) days to appeal the denial to the city council. An application to renew a liquor, beer or wine license may be denied only for reasons which would allow an application for a first license to be denied.
   E.   Appeal: An applicant may appeal the denial of an application to renew a liquor, beer or wine license by physically filing a notice of appeal with the city clerk within ten (10) days of the mailing of the notice of denial. The notice shall state the name and address of the applicant, the type of license for which application was made, the date on which said application was filed, and the reasons why the applicant believes the denial should be overturned.
   F.   Hearing Scheduled: Upon the denial of an application to renew a liquor, beer or wine license by the city clerk, and upon the filing of a timely appeal by the applicant, the city council shall set a time and place for hearing the appeal. The previous license shall remain in effect pending the city council decision on appeal.
   G.   Alcohol Beverage Catering Permit: An alcohol beverage catering permit may not be renewed. (Ord. 3-18, 2001)
