6-2-2: PERMIT REQUIRED:
It is unlawful to erect or construct any structure, building or other work, whether temporary or permanent, in any public right of way in the city, to place any obstruction upon the surface thereof, or to change or disturb, for the purpose of performing any work, the surface or grade of any such right of way without first obtaining an encroachment permit from the city and completing such structure, building or other work in the manner required by the permit to the standards of design and construction adopted by the city. Structures, buildings or other work as contemplated by this section, shall include, but not be limited to, bicycle racks, curbs, gutters, sidewalks, driveways, signs, fences and utilities and other subsurface improvements. This section shall apply to work on property intended to be dedicated to the city as a public right of way. (Ord. 4-36a, 5-2-2005)
