It shall be unlawful for any person to use the streets, sidewalks, or public grounds of the city for signs, signposts, or the posting of handbills or advertisements without written permission of the City Council.

It shall be unlawful for any person to wrongfully or maliciously tear, deface, remove or cover up the posted advertisement or bill of any person, firm or corporation when said bill or advertisement is rightfully and lawfully posted and the same remains of value.

(A) Anyone violating any of the terms and conditions of this chapter shall be deemed guilty of a misdemeanor and shall be fined in a sum not to exceed that permitted by state law for violation of a municipal ordinance. Each day’s maintenance of the same shall constitute a separate offense.

(B) (1) First degree criminal trespass as set out in § 130.02(A) of this chapter is a Class I misdemeanor.
(2) (a) Second degree criminal trespass as set out in § 130.02(C) of this chapter is a Class III misdemeanor, except as provided for in division (B)(2)(b) below.
(b) Second degree criminal trespass is a Class II misdemeanor if the offender defies an order to leave personally communicated to him or her by the owner of the premises or other authorized person.
