It shall be deemed a misdemeanor for any person to willfully destroy, mutilate, deface, injure or remove any tomb, monument, gravestone, structure or thing of value which is located upon any government property, cemetery or property of historic value. Any such offender shall be liable in an action for trespassing in the name of the beneficial holder of said property for all damages which arise from the commission of such unlawful act.
