(A) Level 1 snow emergencies.
(1) During a Level 1 snow emergency, the following parking shall be prohibited as follows.
(a) It shall be unlawful to park on Third Street and Fourth Street from Nebraska Street to East Street during the hours of 2:00 a.m. and 6:00 a.m.
(b) It shall be unlawful to park on East Street, Union Street and Nebraska Street between Third Street and Fourth Street during the hours of 2:00 a.m. and 6:00 a.m.
(2) These hours shall be in effect from October 1 to May 1 of each calendar year.
(3) The city shall cause notices to be posted or shall erect signs indicating such prohibitions.
(4) All vehicles parked on residential streets must be removed within eight hours until the snow is removed from said streets; vehicles remaining on residential streets in excess of eight hours shall be considered to be unlawfully parked.
(B) Level 2 snow emergencies. During a Level 2 snow emergency, the following actions will be taken and parking shall be prohibited as follows.
(1) A Level 2 snow emergency notification will be posted on the city’s electronic sign.
(2) A Level 2 snow emergency notification will be broadcast on the closing/delay banner of a local TV station.
(3) It shall be unlawful to park on any Priority 1 or Priority 2 street until they have been cleared of snow.
(4) All vehicles parked on a Priority 1 or Priority 2 street must be moved within eight hours of the Level 2 snow emergency declaration; any vehicle parked in excess of eight hours shall be considered to be unlawfully parked.
(5) (a) All snow piles will be moved to four designated locations after all streets have been cleared of snow.
(b) The designated locations are as follows:
1. East end of Fourth Street;
2. East end of Third Street;
3. Parking lot of Chief Standing Bear City Park; and
4. City Mixing Plant.
(C) Level 3 snow emergencies. During a Level 3 snow emergency, the following actions will be taken and parking shall be prohibited as follows:
(1) A Level 3 snow emergency notification will be posted on the city’s electronic sign.
(2) A Level 3 snow emergency notification will be broadcast on the closing/delay banner of a local TV station.
(3) A “No Travel Advised” notification will also be posted with the two previously stated notifications.
(4) It shall be unlawful to park on any Priority 1 or Priority 2 street until they have been cleared of snow.
(5) All vehicles parked on a Priority 1 or Priority 2 street must be moved within eight hours of the Level 3 snow emergency declaration or shall be considered to be unlawfully parked.
(6) It shall be unlawful for any person operating a motor vehicle on a Priority 1 or Priority 2 street to allow such vehicle to become stalled or stuck for any reason.
(a) Whenever a motor vehicle becomes stalled or stuck for any reason, the person operating such motor vehicle shall take immediate action to have the vehicle towed or pushed off the roadway onto the nearest Priority 3 street or other appropriate location.
(b) No person shall abandon or leave his or her vehicle in the roadway of a Priority 1 or Priority 2 street except for the purposes of securing assistance in removal of the vehicle.
(c) Any city police officer or other peace officer is hereby authorized to remove or have removed a vehicle which is parked, stalled or abandoned on any Priority 1 or Priority 2 street where the operator cannot be promptly located or the vehicle is interfering with snow removal operations.
(d) The police officer may cause the vehicle to be removed to a private lot or other facility, and such vehicle shall not be released therefrom except upon payment by the owner of all costs in connection with the removal, storage and towing of the vehicle.
(7) (a) All snow piles will be removed to four designated locations after all streets have been cleared of snow.
(b) The designated locations are as follows:
1. East end of Fourth Street;
2. East end of Third Street;
3. Parking lot of Chief Standing Bear City Park; and
4. City Mixing Plant.
(8) Snow that is within five feet of any fire hydrant will be moved once all city streets have been cleared of snow.
(9) The Mayor may elect to call an emergency City Council meeting to determine if assistance is needed in snow removal.
(D) Violations. Any person who shall violate any of the parking terms, conditions or provisions of this schedule shall be fined in a sum not to exceed that permitted by state law for violation of a municipal ordinance. Each day’s (24 hours) maintenance of any of the parking prohibitions contained herein shall constitute a separate offense.
