§ 70.99 PENALTY.
   (A)   (1)   Unless otherwise declared in this title with respect to particular offenses, a violation of any provision of this title shall constitute a traffic infraction.

      (2)   Any person who is found guilty of a traffic infraction in violation of this title for which a penalty has not been specifically provided shall be fined:
         (a)   Not more than $100 for the first offense;
         (b)   Not more than $200 for a second offense within a one-year period; and
         (c)   Not more than $300 for a third and subsequent offense within a one-year period.

   (B)   Any person who refuses to submit to a chemical test of his or her blood, breath or urine for the purpose of determining the alcoholic content of his or her body fluid as set out in § 70.07 of this chapter, after being fully advised of the consequences of such refusal, shall be guilty of a misdemeanor, and on conviction thereof, be fined not more than that amount allowed by state law for violation of a misdemeanor.

   (C)   It shall be considered a misdemeanor for the operator of any vehicle weighing more than the designated limit, as set out in § 70.10 of this chapter, to operate or park said vehicle on such street.
   (D)   Any person who shall violate or refuse to comply with the enforcement of § 70.16 of this chapter, whether set forth at full length herein or incorporated by reference, shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined in a sum not exceeding that permitted by state law for violation of a municipal ordinance for each offense. A new violation shall be deemed to have been committed every 24 hours of such failure to comply.

   (E)   Any person, owner or operator who shall violate the provisions of § 70.31 of this chapter shall be deemed guilty of a misdemeanor and shall be fined in a sum not to exceed that permitted by state law for violation of a municipal ordinance, together with the court costs.
