EDITOR'S NOTE: Article 935 of the Codified Ordinances of the City of Point Pleasant ("Sewer Fees and Charges") was amended and re-enacted by City Council in 2008. First reading of said amendment and re-enactment passed in October, 2008. Second reading passed in November, 2008. Third and final reading passed in December, 2008. Pursuant to the amended and re-enacted ordinance, the new rates were to take effect February 1, 2009. A formal protest of the amended rates was filed by a lone citizen subsequent to the passage of the amended rates, but prior to the same going into effect. Upon the filing of the protest, the West Virginia Public Service Commission asserted jurisdiction over the City's sewer rates and performed a cost-of-service study. By Recommended Decision entered by the WVPSC on June 1, 2009, the ordinance previously amended and re-enacted by City Council was disapproved and set aside. The WVPSC entered a Commission Order on June 30, 2009 which adopted the rates set out in the WVPSC's Recommended Decision as the final order of the WVPSC. Said new rates became effective August 1, 2009. Subsequently, this ordinance was amended to reflect the rates applicable to the City's Combined Sewer Overflow plan. Said rates went into effect in two (2) phases. The first phase was effective 45 days from passage. The second phase went into effect upon substantial project completion or commencement of project debt service.
