7-1-2: ADMINISTRATION OF CODES:
   A.   Administration And Enforcement: The administration and enforcement of the codes adopted in subsection 7-1-1A of this chapter, shall be vested in the person or persons having authority over the subject matter covered by each of said codes. Building permits shall be issued by the person or persons responsible for overall enforcement of the Building Codes (the building official). Such administration and enforcement may, at the option of the City Council, be contracted out to a qualified second party or governmental entity.
   B.   Interdepartmental And Interagency Coordination: To ensure effective coordination with other departments, agencies and organizations with jurisdiction, the building official may request comment and/or require approval from affected agencies prior to issuance of permits. Applications for permits shall meet the following requirements:
      1.   Demonstrate the proposal meets the requirements of this chapter, the codes adopted by this chapter, and the requirements of all other applicable City ordinances. With the application, the applicant shall provide orders of decision approving any associated applications, such as those for variances, conditional use permits, temporary hardship permits, final subdivision plats, planned unit developments, or zone changes.
      2.   Demonstrate the proposal has received required utility permits and approvals from the City of Plummer.
      3.   Demonstrate the proposal has received required access, approach, or encroachment permits or approvals from the City of Plummer, the highway district, Idaho Department of Transportation, and the fire district, as applicable.
      4.   For mobile or manufactured home setting permits, provide verification from the Benewah County Assessor's appraisal Division, that applicable taxes have been paid.
      5.   For encroachments into surface water or wetlands, demonstrate the proposal has received required encroachment permits from the Idaho Department of Lands, Idaho Department of Water Resources, or the U.S. Army Corps of Engineers.
      6.   Demonstrate the proposal has received approval for all relevant requirements from the fire district as applicable.
      7.   Demonstrate the proposal has received approval for all relevant requirements from the Idaho State electrical inspector as applicable.
      8.   Demonstrate the proposal has received approval for all relevant requirements from the Idaho State plumbing inspector as applicable.
   C.   Effective Standards: Permits shall be governed by the laws and regulations in effect at the time a complete permit application is received.
   D.   Access To Property: The property owner or authorized agent's signature on a permit application shall constitute approval for the building official or other person authorized to enforce the codes to enter onto and inspect the property and structures associated with a permit application.
   E.   Withholding Of Permits: The building official may withhold permits, including building permits, on lots or parcels of land with violations of city ordinances. The building official may also withhold or suspend issuance of permits, including building permits, to applicants who have demonstrated a record of unresolved noncompliance with city ordinances.
   F.   Noncompliance; Appeal: If a permit is withheld or issuance thereof suspended, the building official shall set forth the nature of noncompliance in writing. The applicant may submit a written response to the compliance issues raised by the building official. Upon consideration of the response and the full record of performance, the building official shall issue a final ruling in the case, which may include a list of conditions which must be met before any additional permits may be issued. The decision of the building official may be appealed to the city council in accordance with section 7-1-4 of this chapter. Such appeals must be filed within thirty (30) days of the date of the building official's final decision.
   G.   Permit Fees: Applicants shall pay permit fees in amounts to be determined by resolution of the city of Plummer. All permits required under this chapter require fees to be paid prior to a permit being issued, unless specified otherwise herein. (Ord. 430, 12-11-2014)
