A. Any affected person, agency or organization may appeal a decision made by the building official by submitting, within thirty (30) days of the decision, a written request for a public hearing before the city of Plummer council, setting forth with specificity an explanation of the grounds for the appeal. An "affected person" is defined as one having a lawful interest in real property which may be affected by the decision. The final decision on the appeal shall be made by the city of Plummer council.
B. Decisions that may be appealed include, but are not limited to, the denial of a permit or certificate of occupancy due to the refusal of a jurisdiction, other than city of Plummer, to approve the permit or certificate.
C. The application for appeal shall be based on a claim that the true intent of this code or the rules legally adopted thereunder has been incorrectly interpreted, the provisions of this code do not fully apply or an equally good or better form of construction is proposed. The city of Plummer council shall have no authority to waive requirements of the codes as adopted in this chapter. (Ord. 430, 12-11-2014)
