§ 97.02 LIBRARY USER FEE.
   (A)   No library user fee for the issuance of the initial library card shall be charged to a resident of Atascosa County or to a non-resident who owns real property within the county according to the records maintained by the county tax office.
   (B)   All other non-residents shall be charged an annual non-refundable fee of $25 per person for the issuance of a library card. Non-residents holding a current library card will be charged those fees upon the expiration of current card.

§ 97.03 NONCOMPLIANCE WITH LIBRARY RULES AND POLICIES.
   (A)   It shall be unlawful for any person to take from the public library any book, article or other material or property, except in accordance with the rules and policies of the library as approved by the Library Board of Trustees. See § 97.10 below for policies.
   (B)   A person commits an offense if he or she knowingly or intentionally fails to return library materials to the Pleasanton Public Library which were loaned to or borrowed in the patron's name. Intent and knowledge shall be presumed if:
      (1)   Pursuant to agreement, the library materials were to be returned on a date specified;
      (2)   Actual notice is given or notice in writing is sent by depositing in the United States mail stating that the library materials were not returned on the date specified, that notice when mailed to be sent to the address shown on the records of the library;
      (3)   The library material is not returned to the owner within ten days of receipt of the notice;
      (4)   If notice is sent by mail in accordance with division (B)(2) above, it is presumed that the
notice was received no later than five days after it was sent; and
      (5)   In prosecution under this division, it is no defense that the patron, though the actual borrower, no longer possesses the library materials.

§ 97.04 FINES AND LATE CHARGES.
   (A)   Any person failing to return any book, article or other material on or before the designated date shall be liable for fines or late charges for each day of retention as provided by the current rules and regulations of the Pleasanton Public Library Board of Trustees.
   (B)   If the offending person or borrower is under 18 years of age, then the parents or guardian of that person shall be held responsible. Borrowing privileges of the card holder and the parent or guardian shall be suspended until the fines are paid or compensated at the discretion of the Library Director.

§ 97.05 DESTRUCTION OF LIBRARY PROPERTY.
   It shall be unlawful for any person to damage, deface, cut, tear, disfigure or destroy any books, articles or other library materials or any part thereof which belong to, are in the possession of, or were borrowed from the Pleasanton Public Library.

§ 97.06 LOITERING; BREACH OF THE PEACE.
   No person shall loiter on the library lands or in its building in such a manner as to create or cause to be created a danger or a breach of peace or whereby a breach of peace may be occasioned.

§ 97.07 DISTURBING PERSONS ON LIBRARY PREMISES.
   No person shall obstruct, annoy, molest, hinder, threaten, insult or interfere with any person legally enjoying the privileges and use of the library nor shall the offending person make or cause to be made any loud, disturbing or offensive noises or remarks in and upon the grounds and premises of the library.

§ 97.08 VANDALISM.
   It shall be unlawful for any person to willfully or maliciously commit any vandalism or injury or damage to or upon the lands or building of the Pleasanton Public Library or any of its real or personal property including, but not by way of limitation, any furniture, fixtures, shelving, equipment and all other materials belonging to or in the possession of the Pleasanton Public Library.
