It is unlawful for any person in or on any street or sidewalk, or any passageway open to public use, or in or on any public park, playground or community house, or in any automobile while the automobile is on any alley, street or highway or on public, or open to public view, to possess or to consume from any bottle, can or other receptacle, any spirituous, malt, vinous or alcoholic beverages, except that this section shall not pertain to the premises of a residential dwelling as long as such consumption is with the express permission of the owner, the owner's agent or person in lawful possession thereof.
