Furnishing of summary criminal history information to authorized persons.
A. Employment Application. All applicants for employment by the City, including volunteer and contract employment, shall be required to submit to a state- and federallevel fingerprint-based criminal history records check conducted by the City.
B. Authorization for Access. Pursuant to the Penal Code section 11105 (b)(11) authorization for a city, county, city and county or district to conduct a fingerprint-based federal criminal history record checks, the City is authorized to access state- and federal level summary criminal history information for employment purposes for all City employee, volunteer, and contract employee applicants, and may not disseminate the information to any other entity or otherwise disclose such information except as permitted by law. The City shall submit to the Department of Justice fingerprint images and related information required by the Department of Justice for all persons applying for employment, pursuant to Penal Code section 11105(u). The Department of Justice shall provide a state or federal level response pursuant to Penal Code section 11105(p).
C. Moral Turpitude Conviction-Exception. The City shall not consider a person who has been convicted of a felony, nor of a misdemeanor involving moral turpitude, eligible for employment, except that such conviction may be disregarded if it is determined that mitigating circumstances exist, or that the conviction is not related to the employment in question, or as otherwise required by law.
D. Licensees. Licensees, (for example business owners who are legally required and employees, EMT's, etc.), shall submit electronic fingerprint images, and related information required by the Chief of Police for the purpose of obtaining information as to the existence and content of a record of state or federal convictions and arrests to be considered as set forth in this chapter.
