A. Any person violating any of the provisions of this article or knowingly or intentionally misrepresenting to any officer or employee of the city any material fact in procuring the license or permit or registration provided for in this article shall be deemed guilty of an infraction, and upon conviction thereof, shall be punishable by the following:
1. A fine not exceeding fifty dollars for a first violation;
2. A fine not exceeding one-hundred dollars for the second violation of the same ordinance within one year; and
3. A fine not exceeding two-hundred-fifty dollars for each additional violation of the same ordinance within one year.
B. The phrase “violation of the same ordinance,” as used in this section, means and refers to a violation of the same numbered section of this article. (Ord. 392 § 3, 1980: Ord. dated 9/17/79: Ord. 338 § 46, 1975).
