3.20.099 DISPOSITION OF IMPACT FEES.
   A.   To avoid commingling of the DIF with other revenues and funds of the city, the city shall deposit any DIF collected pursuant to Section 3.20.093 in a separate Development Impact Fee Fund (the "DIF Fund"), which shall consist of individual accounts for each category of public facilities specified in that subsection, as such subsection may be amended from time to time. The DIF Fund shall be interest bearing and the accumulated interest shall become a part of the Fund and shall be allocated amongst the individual accounts therein.
   B.   The DIF (hereinafter referred to collectively as the "funds" shall be used only to:
      1.   Fund the capital costs for the public facilities adopted by resolution of the City Council pursuant to Section 3.20.093. The costs of construction of public facilities shall include acquisitions of property and property rights, costs of construction, including costs associated with planning, administration and design, as well as actual building or installation, or any other costs associated with the construction of the public facilities.
      2.   Reimburse the City of Pinole to offset administrative costs associated with administering and updating the impact fee program.
      3.   Make refunds if and when required by the applicable sections of Government Code Section 66000 et seq., or any applicable successor statutes. (Ord. 2008-03 § 2 (part), 2008)
