As specified in A.R.S. Section 48-3609, the provisions of this title shall not affect or prohibit:
A. Existing legal uses of property or the right to continuation of such legal uses. However, if nonconforming use of land, building or structure is discontinued for twelve consecutive months; or is destroyed to the extent of fifty percent or more of its value, as determined by a competent appraiser, any further use shall comply with this title;
B. Reasonable repair or alteration of property for the purposes for which the property was legally used on December 16, 1974, except that any alteration, addition, or repair to a nonconforming building or structure which would result in increasing its flood damage potential by fifty percent or more shall be either flood-proofed or elevated to, at, or above the regulatory flood elevation with written authorization required pursuant to A.R.S. Section 49-3613 and Section 16.12.050 of this chapter;
C. Reasonable repair of structures constructed with the written authorization required by A.R.S. Section 48-3613; and
D. Facilities constructed or installed pursuant to a certificate of environmental compatibility issued pursuant to Title 40, Chapter 2, Article 6.2, of A.R.S. Section 40-360, et seq.
