A. If a special permit application is denied, a previously issued special permit is revoked and confiscated, or a permit applicant believes a condition associated with an issued special permit is invalid, the permit applicant may appeal by submitting an administrative appeal application form via email to oversizeoverweightpermit@pima.gov. The administrative appeal application form must be in a form prepared by the department and available on the department's website at http://webcms.pima.gov/cms/One.aspx?portalId=169 &pageId=67525. In order for the appeal to be considered, the permit applicant must:
1. Submit the administrative appeal application form within seven calendar days of the department's denial or revocation and confiscation of the special permit that is the subject of the appeal, or, in the event of a challenge to a permit condition, within seven calendar days of issuance of the special permit or application that is the subject of the appeal;
2. Specify either the permit that has been denied or revoked and confiscated or the permit condition that the permit applicant challenges;
3. Explain the basis for the permit applicant's appeal.
B. The director or designee will review the administrative appeal application form and issue a written decision to the permit applicant, based on the written submission, within seven calendar days of the date the administrative appeal application form was submitted.
C. A permit applicant aggrieved by a decision of the director or designee under Section 10.36.100(B) may, within seven calendar days of receiving that decision, appeal in writing to the county administrator. The county administrator will decide the appeal based on the written submission and issue a written decision to the permit applicant within seven calendar days. The county administrator's decision is final.
