A. A prospective employee, contract instructor or volunteer shall, with the full set of fingerprints, complete and submit a notarized form, provided by Pima County Natural Resources, Parks and Recreation Department, indicating whether he or she is subject to registration as a sex offender in this state or any other jurisdiction or is awaiting trial on or has ever been convicted of committing, or attempting or conspiring to commit, one or more of the following offenses in this state or the same or similar offenses in another state or jurisdiction:
1. First or second degree murder.
2. Kidnapping.
3. Arson.
4. Contributing to the delinquency of a minor.
5. Felony offenses involving distribution of marijuana or dangerous or narcotic drugs.
6. Theft.
7. Robbery.
8. Manslaughter.
9. Aggravated assault.
10. Domestic violence.
11. Fraud or fraudulent schemes.
12. Assault within the last five years from the date of submitting a full set of fingerprints to Pima County Natural Resources, Parks and Recreation Department.
13. Possession or use of marijuana or a dangerous or narcotic drug within the last five years from the date of submitting a full set of fingerprints to Pima County Natural Resources, Parks and Recreation Department.
14. Sexual Abuse of a Minor.
15. Sexual Abuse of a Vulnerable Adult.
16. Incest.
17. Sexual Assault.
18. Sexual Exploitation of a Minor.
19. Sexual Exploitation of a Vulnerable Adult.
20. Commercial Sexual Exploitation of a Minor.
21. Commercial Sexual Exploitation of Vulnerable Adult.
22. Child Prostitution as defined in A.R.S. § 13-3212.
23. Child Abuse.
24. Abuse of a Vulnerable Adult.
25. Sexual Conduct with a Minor.
26. Molestation of a Child.
27. Molestation of a Vulnerable Adult.
29. A Dangerous Crime Against Children, as defined in A.R.S. § 13-604.01.
29. Exploitation of Minors Involving Drug Offenses.
30. Taking a Child for the Purposes of Prostitution, as described in A.R.S. § 13-3206.
31. Neglect or Abuse of a Vulnerable Adult.
B. A current employee, contract instructor or volunteer shall, at the time such person submits the full set of fingerprints pursuant to Section 9.50.020, complete and submit a notarized form, provided by Pima County Natural Resources, Parks and Recreation department, indicating whether he or she has ever been convicted of, or is awaiting trial on, any of the criminal offenses enumerated in paragraph A of this section in the state of Arizona or similar offenses in any other state or jurisdiction.
C. Each employee, contract instructor or volunteer shall, as a condition of continued employment, annually complete and submit a notarized form, provided by Pima County Natural Resources, Parks and Recreation department, indicating whether, since the date of submitting his or her last sworn statement, he or she has been convicted of, or is awaiting trial on, any of the criminal offenses enumerated in paragraph A(1) through A(31) of this section, in the state of Arizona or similar offenses in any other state or jurisdiction.
