A. A person found responsible for a fifth false alarm in violation of Section 9.13.040 shall be punished by a minimum civil penalty of one hundred twenty-five dollars; a penalty not to exceed one thousand dollars may be imposed. False alarm incidents may form the basis of more than one violation of Section 9.13.040.
B. A person found responsible for a sixth false alarm in violation of Section 9.13.040 shall be punished by a minimum civil penalty of two hundred fifty dollars; a penalty not to exceed one thousand dollars may be imposed. False alarm incidents may form the basis of more than one violation of Section 9.13.040.
C. A person found responsible for a seventh false alarm in violation of Section 9.13.040 shall be punished by a minimum civil penalty of three hundred seventy-five dollars; a penalty not to exceed one thousand dollars may be imposed. False alarm incidents may form the basis of more than one violation of Section 9.13.040.
D. The fine amount for a person found responsible for each false alarm occurring thereafter within the same three-hundred-sixty-five-day period shall increase by increments of not less that one hundred twenty-five dollars nor more than one thousand dollars for each violation.
E. A person found responsible for a violation of Section 9.13.050 shall be punished by a minimum civil penalty of five hundred dollars; a penalty not to exceed one thousand dollars may be imposed.
F. No penalty imposed under this chapter may be suspended, waived or otherwise made conditional in sanctioning a person found responsible of violations of the offenses set out in this chapter.
G. A report from the Pima County sheriff's department documenting a sheriff's response to an alarm and an investigation which revealed no emergency shall constitute prima facie evidence of a false alarm.
