A. A waiver from the requirements in Section 7.25.120.A may be issued to a waste collector if the waste collector provides a written request to the director and the waste collector meets all the following requirements:
1. The waste collector has fewer than twenty full-time employees in Pima County; and
2. The waste collector demonstrates that the requirements of 7.25.120.A pose an undue economic hardship.
B. The director shall act upon a request for a waiver within sixty days upon its receipt.
C. A waste collector that is denied a waiver may appeal the decision of the director pursuant to Section 7.03.145.
D. The director shall assess a fee to waste collectors requesting a waiver pursuant to subsection A. The fee shall not exceed the actual cost of services provided in processing the request.
E. A waiver granted pursuant to this section shall remain valid for a period of time determined by the director, but in no event shall a waiver exceed five years.
F. A waste collector that has received a waiver pursuant to this section shall not offer recycling services to its customers unless it complies with all of the requirements of this chapter.
