(A) National categorical pretreatment standards. National categorical pretreatment standards as promulgated by the U.S. Environmental Protection Agency (EPA) pursuant to the Act and adopted as § 52.37 of this code shall be met by all dischargers of the regulated industrial categories, unless the local limits are more stringent. An application for modification of the national categorical pretreatment standards may be considered for submittal to the regional administrator by the town or the authority, when the town or the authority’s wastewater treatment system achieves consistent removal of the pollutants as defined by 40 C.F.R. § 403.7.
(B) State requirements. State requirements and limitations on discharges to the POTW shall be met by all dischargers which are subject to such standards in any instance in which they are more stringent than federal requirements and limitations or those in any other applicable ordinance or this code.
(C) Right of revision. The town reserves the right to amend this subchapter to provide for more stringent limitations or requirements on discharges to the POTW where deemed necessary to comply with the objectives set forth in § 52.17 of this code.
(D) Dilution. No discharger shall increase the use of potable or process water in any way, nor mix separate wastestreams for the purpose of diluting a discharge as a partial or complete substitute for adequate treatment to achieve compliance with the standards set forth in this subchapter.
(E) Supplementary limitations.
(1) Reference § 52.36 of this code for conventional and other pollutants not indicated in the following table. Those pollutants found in § 52.36 of this code and in the following table shall not be discharged at a flow rate or pollutant concentration which will cause interference to the POTW. No discharger shall discharge wastewater containing concentrations of the following enumerated materials, exceeding the following average monthly concentration or a daily maximum concentration based upon twice the average monthly concentration reported herein:

(2) Although the reported values in division (E)(1) above are average monthly amounts, electroplating industries will be allowed to meet the daily maximum and four-day average concentrations for the metals covered in the electroplating categorical pretreatment standards of 40 C.F.R. part 413 and these shall also be applied to the discharge of wastewater to the POTW by an electroplating industry. See § 52.37 of this code for categorical pretreatment standards for electroplating. However, these supplementary limitations, if more stringent than the categorical limits, will be the guideline if the company has the technology to meet the limits or to reduce the level of the chemical below the supplementary limitations. If a company does not have the technology or the technology does not exist, then the company will provide a study detailing the levels it can reach without causing a financial hardship. The authority or the town will then consider what mass limitations can be accepted.
(3) The town may impose mass limitations on dischargers which are using dilution to meet the pretreatment standards or requirements of this subchapter, or in other cases where the imposition of mass limitations is deemed appropriate by the authority or the town.
(4) In the event of an organic chemical discharge, the town shall control such discharge by imposing the limit at one-fourth of the current existing water quality criteria level. In the event such limit is insufficient to control treatment plant upset, then the town will either determine a more safe level of discharge or ban such discharge.
