1292.09    DIGITAL MENU BOARD SIGN REQUIREMENTS FOR DRIVE THRU RESTAURANTS.
   (a)   Definitions.
      (1)   "Digital menu board (DMB)" means an electronic, changeable sign or portion of sign that emits light to display messages and images, and whose variable message and graphic presentation capability can be altered from a remote location.
   (b)   Requirements. All DMBs are subject to the following requirements:
      (1)   Comprehensive sign plan approval. The DMB shall require a comprehensive sign plan approval.
      (2)   Location. The DMB shall be oriented solely for the use of patrons utilizing the drive thru.
      (3)   Setbacks. The DMB shall be located not less than the minimum required building setback of the zoning district.
      (4)   Allotment. No more than one DMB shall be displayed per drive thru lane. No more than two total DMBs shall be displayed per restaurant location.
      (5)   Measurements. The total display area of the DMB shall not exceed thirty- six square feet. The height of a DMB shall not exceed seven feet.
      (6)   Sign colors. The exterior color of the DMB shall be limited to amber (brownish), white, or a similar color. Multiple colors may be permitted for the display area. Any material change shall require comprehensive sign plan approval by the Planning and Zoning Commission.
      (7)   Display content. DMB shall only be utilized for the promotion of a business, products or services available on the premises where the DMB is located.
      (8)   Intensity of light. The maximum luminescence produced by the sign shall not exceed three-tenths foot candle greater than the ambient light level. The light level produced by the sign shall be measured using the following equation based on a typical sign-to-viewer distance: the square root of the product of the sign area multiplied by 100. Example using a twelve square foot sign:
measuring distance. Automatic dimming capability shall be implemented to adjust the signs illumination to the ambient light at all times of the day or night.
      (9)   Maintenance. Regular maintenance is required to ensure that each component and part operates as designated. If more than ten percent of the illumination area are not functioning, the use of DMB shall cease until it is repaired and fully functioning.
   (c)   Prohibited. Flashing content is prohibited on a drive thru DMB.
