1462.06 VARIANCES.
   When extraordinary circumstances exist making the strict enforcement of this chapter unreasonable, a variance procedure is herein provided for from the location of earth station requirements of Section 1462.04. The person seeking a variance shall file two copies of a provided application, accompanied by a copy of the denial of the appeal provided for in this chapter with the Manager not more than twenty days from the date of the denial of the appeal. The application shall be consistent with the requirements of Section 1272.05 of the Zoning Code and shall be considered by the Board of Zoning Appeals after the Manager has submitted a written recommendation of approval, modification or disapproval of the variance and the reasons therefor. The Board shall hold a public hearing on the variance and shall use the standards imposed by Section 1272.05 of the Zoning Code in determining whether to grant, deny or modify the requested variance. In addition, a variance shall only be granted if the Board determines that a significant loss of reception shall occur if a ground-mounted earth station is utilized.
