1109.03   MINOR SUBDIVISION.
   (a)   Planning Commission May Grant Authority of Review and Approval. The Planning Commission may designate a representative to review and approve a minor subdivision.
   (b)   Preapplication Meeting. The subdivider shall meet with the Perry Village Planning Commission, or its representative, prior to the submission of plans. The purpose of this meeting is to discuss early and informally the purpose and effect of these Regulations on the proposed subdivision. The appropriate forms shall be obtained (See Appendix A and Appendix B).
   (c)   Submission to Planning Commission. Any person proposing to create a minor subdivision shall submit the following to the Perry Village Planning Commission.
      (1)   The instrument of conveyance. (See Appendix A.) The conveyance shall contain a description of the parcel or parcels sought to be transferred. The conveyance shall be accomplished by the recording of a deed rather than a plat. The party or parties desiring to make the transfer shall submit a sketch thereof to the Commission's authorized representative. If the division conforms to appropriate standards, and requirements established herein, the responsible official may stamp same "Approved, No Plat Required", and attach his signature, and the appropriate transfer may then be recorded. In no case where a division takes place, may the remaining portion of the tract be less than the minimum allowable lot size. However, if the owner of the property does not agree with any of the requirements specified by the Commission, or its duly appointed representative, he may then appeal to the Planning Commission for approval for recording and such approval must be obtained before the transfer can be recorded. No preliminary or final plan other than the rough sketch of the division shall be required.
      (2)   A statement by the owner that the parcel or parcels of land created comply with existing Village Zoning Regulations and certified as such by the Zoning Inspector of the Village in which land sought to be transferred is located.
      (3)   A statement of recommendation by the County Health Board (or the County Sanitary Engineer where public sewers are required) for approval of transfer in one (1) of the following forms:
         A.   Approved for building sites (valid for one (1) year):
            1.   Public Sewer required by Lake County Sanitary Engineer.
            2.   Public Sewer not required by Lake County Sanitary Engineer. Individual sewage systems have been approved by the Lake County Health Board.
         B.   Approved for transfer: No building site approval granted.
      (4)   Minor subdivision fees.
   (d)   Submission to Tax Map Department. After approval and conveyance by the Planning Commission, the following, bearing the approval stamp of the Planning Commission, shall be presented to the Tax Map Department. At this time the Tax Map Department shall collect appropriate fee.
   (e)   Submission to the Auditor. Following approval and conveyance by the Tax Map Department, the conveyance bearing the approval stamp of the Tax Map Department shall be presented to the Auditor for approval. At this time the Auditor shall collect appropriate fees.
   (f)   Submission to the Recorder. Following approval of the conveyance by the Auditor, the conveyance bearing the stamp of the Auditor shall be presented to the Recorder for recording. At this time the Recorder shall collect appropriate fees.
   (g)   Minor Subdivision Requirements. All minor subdivisions shall meet with the following regulations:
   The sketch (see Section 1109.03(c)) shall indicate the following information:
      (1)   Approximate location of low, wet, or swampy areas and existing drainage courses, including storm sewers, tile lines and roadway culverts, where known.
      (2)   The general location of all structures on the parcel and on the land from which the parcel is being split, if within fifty (50) feet of the new line.
      (3)   The amount of acreage in total and in each lot and the amount of acreage in road right-of-way and other easements.
      (4)   The location of power lines or other utility easements, where known.
      (5)   The proposed building set-back lines.
      (6)   Approximate location of any other unusual feature such as large rock outcroppings or underground mines, gas wells, driveways, etc., where known.
      (7)   Any other information deemed necessary by the Planning Commission.
   (h)   Action by the Planning Commission. Approval without a plat of a Minor Subdivision shall be granted by the Planning Commission if the proposed division of a parcel of land meets all of the following requirements:
      (1)   The proposed subdivision is located along an existing public street and involves no opening, widening, or extension of any street;
      (2)   No more than five (5) lots are involved after the original tract has been completely subdivided;
      (3)   The proposed subdivision is not contrary to applicable subdivision or zoning regulations. Within fifteen (15) working days after submission of a Minor Subdivision or within a mutually agreed upon extension, the Planning Commission shall either approve or disapprove the application for transfer without a record plat. The approval shall expire within sixty (60) days, unless the conveyances are recorded in the office of the County Recorder during said period. If the Planning Commission representative does not approve the transfer, he shall notify the applicant, in writing, stating the reason for disapproval.
   (i)   Action by Tax Map Department. The Tax Map Department shall review each major and minor subdivision and each transfer of ownership to assure proper chain of title, tax map accuracy and compliance with requirements contained herein. The approval shall expire within sixty (60) days, unless the conveyances are recorded in the office of the County Recorder during said period.
