§ 154.110 CONTRIBUTION REQUIRED.
   (A)   As a condition to the issuance of any approval of a final plat of subdivision, or a planned unit development, each owner, subdivider or developer shall contribute, at the option of the village, either 10% of the land to be developed or cash in an amount of $1,000 per lot zoned for construction of a single family residence, which land or cash shall be for public services, facilities and open space purposes to serve the needs of the residents of the development.
   (B)   The contribution required by division (A) shall be paid to the village upon final plat approval, and contributions shall be made for all phases of a development upon the approval of a final plat for any one of those phases, and shall be used according to the needs of the residents as determined herein by the village.
   (C)   In conjunction with any plat review and prior to any plat approval of any developer, builder, or subdivider who is subdividing any real estate beyond the existing, but within 1.5 miles of the corporate limits of the village, said developer, builder or subdivider shall concurrently pay to the village at the time of plat approval the contribution fee as required in division (A), including payment for all phases of the development.
   (D)   The land or cash contributions required herein shall also be required as a condition to the annexation of any land to the village; and provisions therefor shall be incorporated in any preannexation or annexation agreement governing such land.
    (E)   Donation to the village of land required for water detention or retention shall not relieve an owner, subdivider or developer from the obligation to make the land or cash contribution for public usage required herein.
