(A) Filing.
(1) After approval of the preliminary plat by the Board of Trustees and the fulfillment of the requirements of these regulations, the subdivider shall apply, in writing, to the Chairperson of the Plan Commission for approval of a final plat. The final plat shall conform substantially to the preliminary plan as given conditional approval. The application shall be in duplicate and shall be accompanied by the original inked plat on tracing cloth or mylar type plastic, and five prints, specifications for the final plat and other documents to accompany the application are set forth in division (B) of this section. The final plat will not be considered as submitted unless it is in agreement with specifications and accompanied by required documents.
(2) The Plan Commission shall within 30 days submit its recommendation to the Board of Trustees as to whether such final plat should be approved and the Board of Trustees shall approve, disapprove or approve with modifications the proposed plat within 60 days from the date of filing of the last document required to be filed for final plat approval. Action by the Board of Trustees may be by resolution setting forth all conditions upon which approval or disapproval (or modifications) is predicated. The determination of the Board of Trustees shall be delivered to the subdivider by the Village Clerk. No such final plat shall be signed or recorded until the required bond or letter of credit is provided in accordance with the provisions of § 154.046 of this chapter.
(3) Upon receipt of approval by the corporate authorities, the developer shall record the plat with the County Recorder within 30 days. If the final plat has not been recorded with the County Recorder within three months, approval of said final plat shall be null and void.
(4) The tracing of the final plat, after the plat is recorded, will be filed and retained in the office of the village. If the plat is disapproved, the tracings and prints shall be returned to the Plan Commission with a copy of the Board's resolution.
(5) Upon approval by the Board of Trustees, all documents accompanying the final recorded plat shall be kept in the files of the Village Clerk.
(B) The final plat shall contain the following:
(1) Identification and description.
(a) Name of subdivision.
(b) Location by township, section, town, and range or by other legal description.
(c) Names of owners, developers, and sponsors and certification by a licensed surveyor.
(d) Scale one inch to 100 feet shown graphically.
(e) Date.
(f) Northpoint.
(2) Delineation.
(a) Boundary of plat, based on an accurate traverse with angular and lineal dimensions.
(b) Exact location, width and names of all streets within and adjoining the plat and the exact location and widths of all crosswalkways. Proposed street names shall be checked with and approved by the Village Board of Trustees and, where applicable, the proper county officials.
(c) True angles and distances to the nearest established street lines or official monuments (not less than three) which shall be accurately described in the plat by location, size and elevation.
(d) Municipal, township, county, or section lines accurately tied to the lines of the subdivision by distances and angles.
(e) Radii, internal angles, points and curvatures, tangent bearings, and lengths of all arcs.
(f) All easements for rights-of-way provided for public services and utilities.
(g) All lot numbers and lines with accurate dimensions in feet and hundredths.
(h) Accurate location of all monuments, which shall be iron pipe at least one inch in diameter and at least 15 inches long set in a concrete base 48 inches in depth with a base of six inches in diameter and four inches in diameter at the top. Permanent monuments shall be set at each corner or angle on the outside boundary and such other places as directed by the Plan Commission upon submission of the plat. Iron stakes not less than one foot long or stone or concrete not less than four inches in diameter and 24 inches long, shall be sunk in the ground at all lot corners and angle points and at the ends and at suitable intervals along curves. All United States, state, county, or other official benchmarks, monuments, or triangulation stations in or adjacent to the property shall be preserved in precise position. All monuments and official markers shall be indicated on all plats for recording.
(i) Accurate outlines and legal descriptions of any areas to be dedicated or reserved for public use, with the purpose indicated thereon and of any area to be reserved by deed covenant for common uses of all property owners.
(j) Building setback lines accurately shown by dimensions.
(k) Protective covenants which meet with the approval of the Plan Commission shall be lettered on the final plat.
(l) Detailed plan of existing and proposed sewers, water mains, culverts, storm sewers, or other underground facilities within the tract indicating pipe sizes, grades, manholes, and exact location.
(3) Certification.
(a) Certification by a registered surveyor to the effect that the plat represents a survey by him and that monuments and markers shown thereon exist, as located, and that all dimensional and existing and proposed geodetic details are correct.
(b) Notarized certification, by owner or owners, or by any mortgage holder on record or other persons having an interest therein of the adoption of the plat and the dedication of streets and other public areas.
(c) Certification by signatures of proper officials of the county showing that all taxes and special assessments due on the property to be subdivided have been paid in full.
(d) Certification, by signatures of the Village President and Village Attorney, that satisfactory provisions have been made for guarantee of performance of construction of required improvements. On items where construction has already been completed, there shall be certification by the Village President and Village Attorney that construction has been completed, inspected, and found to be in accordance with village standards and requirements and that surety has been posted to provide for repair of damage done while the subdivision is being completed.
(e) Certification by signature of the Village Attorney that satisfactory conveyances to the village have been provided applying to rights-of-way for streets, alleys and easements and for land for parks, playgrounds and other public uses.
(f) Certification, by signature of the Village Clerk, that there are no special assessments, delinquencies or other liens.
(g) Approval, by signature of village, county, and state officials, concerned with the specifications of utility installations.
(h) Approval, by signature of the Chairperson of the Plan Commission. This approval of the final plat shall not be deemed to constitute or affect an acceptance by the public of the dedication of any street or other proposed public way or space shown on the plat.
(i) Proper form for the approval of the Board of Trustees with space for date and signature of the Village President.
(j) Surface water drainage certificate (engineer).
(k) Surface water drainage certificate (owner).
