§ 158.056 MAINTENANCE RESPONSIBILITY.
   (A)   Maintenance of stormwater drainage facilities located on private property shall be the responsibility of the owner of that property. Before a permit is obtained from the Village of Peotone the applicant shall execute a maintenance agreement with the Village of Peotone guaranteeing that the applicant and all future owners of the property will maintain its stormwater drainage system. The maintenance agreement shall also specifically authorize representatives of the village to enter onto the property for the purpose of inspections and maintenance of the drainage system. Such agreement shall be recorded with the Recorder of Deeds of Will County. The maintenance agreement shall include a schedule for regular maintenance of each aspect of the property's stormwater drainage system and shall provide for access to the system for inspection by authorized personnel of the Village of Peotone. The maintenance agreement shall also stipulate that if the village notified the property owner in writing of maintenance problems that require correction, the property owner shall make such corrections within 30 calendar days of such notification. If the corrections are not made within this time period the village may have the necessary work completed and assess the cost to the property owner.
   (B)   The Village of Peotone has the option of requiring a bond to be filed by the property owner for maintenance of the stormwater drainage system.
      (1)   Registered professional engineers. The applicant shall provide an Illinois Registered Professional Engineer or persons working under his or her direct control and authority to provide construction stake out and construction observation periodically as required when work is being performed. The applicant's registered professional engineer shall provide progress reports approved by him to the village and the Village Engineer on a weekly basis if determined to be necessary by the village.
      (2)   Professional landscape architect or wetland designer/ecologist. The applicant shall provide a professional landscape architect or wetland designer/ecologist or persons working under their direct control and authority to provide construction stake out and construction observation periodically as required when landscaping work is being performed. The applicant's professional landscape architect or wetland designer/ecologist shall provide detailed reports approved by him or her to the village and the Village Engineer on a weekly basis if determined to be necessary by the village.
