§ 92.07 SPECIFIC PROHIBITIONS.
   The following acts are specifically prohibited as further illustrations, or in addition to the general prohibitions contained in §§ 92.03, 92.05, and 92.08, and not, in any form or interpretation, in lieu of the general prohibitions contained in §§ 92.03, 92.05, and 92.08.
   (A)   Horns, signaling devices. The sounding of any horn or signaling device on any motor vehicle or any street or public place in the unincorporated area of this town continuously and/or incessantly for a period of excess of 60 seconds, except as a danger warning.
   (B)   Radios, television, musical instruments and similar devices.
      (1)   The operating or playing of any radio, musical instrument and devices commonly known as boom boxes or similar device which produces or reproduces sound on the public rights-of-way, other than as specified in division (B)(2) of this section, in such a manner as to be plainly audible to any person other than the operator of the device.
      (2)   The operating or playing of any radio/boom box, television, phonograph, musical instrument or similar device which produces or reproduces sound in a motor vehicle or public area or area with public access or in public use, in a manner as to be plainly audible at a distance of 50 feet or inside any residence other than the sound source.
      (3)   The operating or playing or any radio/boom box, television, phonograph, musical instrument or similar device which produces or reproduces sound in such a manner as to exceed the levels set forth in Table 1.
   (C)   Loudspeakers and sound amplifiers. The using or operating of any loudspeaker, loudspeaker system, sound amplifier or other similar device (collectively, “sound systems”) between the hours of 10:00 p.m. and 7:00 a.m. on weekdays and 10:00 p.m. and 10:00 a.m. on weekends and holidays, within or adjacent to residential or noise sensitive areas such that the sound there from is plainly audible across the real property line of the source and/or to the interior of any residence, business or building other than the sound source; during all hours, such use of sound systems will be a violation if the resulting sound or noise occurs continuously or incessantly at anytime of day or night for a period often minutes or intermittently over a continuous period of one-half hour or more during any 24-hour period, all to the disturbance of any person; any business operating any sound systems must contain sound from such device(s) within the premises or property where the business exists. Keeping sound inside the premises or property may be done with structural enhancements or acoustical treatments, or lowering of volume from the sound systems. Such sound systems used in any outdoor or outdoor-like environment, such as a patio area, must not be directed so as to point away from the business and/or toward any other home or business without the express, written approval of those affected by such use.
   (D)   Street sales and auctions. The offering for sale by shouting or outcry/ whether amplified or not, within any residential, commercial or noise-sensitive area except upon permission by the town.
   (E)   Animals. The owning, possessing or harboring of any animal which frequently, or for continued duration, howls, barks, meows, squawks or makes other sounds which create excessive and unnecessary noise across a residential or commercial real property line or within a noise-sensitive area. For the purpose of this chapter “barking dog” shall mean a dog that barks, bays, cries, howls or makes any other noise continuously and/or incessantly for a period often minutes, or barks intermittently for one- half hour or more to the disturbance of any person at any time of day or night, regardless of whether the dog is physically situated in or upon private property; provided however, that a dog shall not be deemed a barking dog if, at the time the dog is barking or making any other noise, a person is trespassing or threatening to trespass upon property in or upon which the dog is situated.
   (F)   Emergency signaling devices. Subject to the exemptions of § 92.06(b), herein;
      (1)   Except in case of an emergency, the intentional sounding of any alarm between the hours of 10:00 p.m. and 7:00 a.m.;
      (2)   The testing of any alarm for a period in excess of 60 seconds at any time; and
      (3)   The testing of a complete emergency signaling system, including the signaling device and the personnel response to the signaling device, more than once in each calendar month, and the sounding of the emergency signaling system for a period in excess of 15 minutes.
